Davit Avagyan has represented plaintiffs and defendants in high-stakes appellate and trial litigation as well as transactions and negotiations. As Rushing McCarl’s first associate, he has gained experience across a wide variety of practice areas while helping the firm build a reputation for excellent work. He played a material role in helping the firm secure a $17.8 million federal jury verdict in its first trial.

Before joining Rushing McCarl, Mr. Avagyan worked as a litigator at another Los Angeles law firm as well as a post-bar law clerk in the fraud and special prosecutions section of the California Department of Justice.

Previously, Mr. Avagyan worked as a judicial extern for the United States District Court for the Northern District of Indiana and a certified law clerk in the Los Angeles District Attorney’s Office. He also completed legal internships with Red Lion Chambers and with Laura Devine Solicitors in London, UK, as well as with the Human Rights Ombudsman of the Republic of Artsakh in Stepanakert.

Mr. Avagyan has a J.D. with Honors from the University of Notre Dame Law School, where he was a staff editor of the Journal of International and Comparative Law, a  member of the Notre Dame Vis Moot Team, founder and president of the Armenian Student Association of Notre Dame, and London liaison of the International Law Society. He also has a B.A. in political science from the University of California, Davis with a minor in human rights.

Mr. Avagyan is fluent in Armenian and has a working knowledge of Russian.

Notable Results

  • Secured a $17.8 million unanimous federal jury verdict in a breach-of-contract case. Virgin Scent, Inc. v. BT Supplies West, Inc., Case No. 2:21-cv-00184-DMG-AS (C.D. Cal 2022). Mr. Avagyan was third chair and played a material role in trial preparation.
  • Obtained a Ninth Circuit reversal of an order granting a motion to dismiss an airline passenger’s claims relating to an in-flight assault. Doe v. Compania Panamena de Aviacion, Case No. No. 21-55983 (9th Cir. 2022).  You can watch John Rushing’s oral argument here.
