About

Drew Musto has represented plaintiffs and defendants in high-stakes appellate and trial litigation, transactions, and negotiations. He practices in areas including partnership and contract disputes, fraud litigation, entertainment law, employment law, securities law, and consumer protection law. Drew also played a leading role in drafting Rushing McCarl’s amicus brief for the Due Process Institute in support of a petition for certiorari to the United States Supreme Court.

Drew developed his passion for litigation and legal writing while clerking for the Hon. Kevin Newsom of the United States Court of Appeals for the Eleventh Circuit. Before that, he participated in Stanford Law School’s Supreme Court Litigation Clinic, where he was part of the team that drafted winning merits briefs in Hemphill v. New York (2022), a critical constitutional law case.

Drew grew up in Newtown, Pennsylvania, a borough founded by William Penn in 1684. He is an avid hiker and completed the Everest Base Camp trek in 2023 and a marathon Grand Canyon hike in 2024.

Rushing McCarl LLP is a California business-litigation boutique that the Daily Journal recently called a “new litigation powerhouse.” You can view examples of Rushing McCarl’s public work here.
