Do business interruption insurance policies cover COVID-19 losses? Some courts may hold that the answer is yes, according to a new Daily Journalarticle by Ryan McCarl and John Rushing.
A recent decision out of the Western District of Missouri in the case Studio 417, Inc. v. Cincinnati Ins. Co., 20-cv-03127-SRB (W.D. Mo. Aug. 12, 2020), suggests that some courts will hold that business interruption insurance covers COVID-related losses if the policy’s coverage language is broad enough and if the policy does not exclude losses due to viruses or pandemics. The Studio 417 ruling is vitally important to business owners, insurers, and their counsel.
